Judicial Activism Must End Now!

In the heart of Manhattan's criminal courthouse, Gerardo Miguel Mora stood before Judge Sheridan Jack-Browne on that fateful Thursday in early 2026. Mora, 45, carried a rap sheet stained with violence: attempted rape and strangulation of a 21-year-old woman in 2011, deportation afterward, illegal reentry, crack cocaine possession in January 2026, and now shoplifting $130 from an H&M.

The Federal Warrant

Federal agents from ICE waited outside with a criminal arrest warrant for reentry under 8 U.S.C. § 1326, a felony. The warrant sat in the judge's file, clear as day. Agents expected a handover. Federal law supremacy demanded it, rooted in the U.S. Constitution's Article VI, Clause 2, the Supremacy Clause, which binds state judges to federal authority, overriding conflicting state actions.

Yet Jack-Browne chose defiance. She nodded to a bailiff. "Release him out the back," she whispered. Mora slipped into the alley, evading the front where ICE loomed.

Chaos erupted. Agents, alerted, chased Mora through crowded streets, tackling him blocks away. A controlled transfer turned perilous, risking lives.

This was no isolated act. New York courts had become shields for the undocumented, judges ushering criminals outside doors, defying ICE detainers. Each time, agents resorted to street pursuits, chaos blooming where order should reign.

Judicial Silence and Precedents

Jack-Browne's silence spoke volumes. Requests for comment went unanswered. Her act echoed real cases of judicial obstruction. In 2019, Massachusetts Judge Shelley M. Joseph faced indictment under 18 U.S.C. § 1505 for obstructing ICE by releasing an immigrant out a back door, and under 18 U.S.C. § 1071 for concealing him from arrest. Similarly, in 2025, Wisconsin Judge Hannah Dugan was charged for aiding evasion, proving judges lack immunity from criminal prosecution for such acts, as judicial immunity shields only civil suits, not federal crimes.

This is obstruction, punishable under 18 U.S.C. § 1503 for interfering with judicial proceedings, or § 1505 for administrative ones like ICE enforcement. Harboring illegal aliens violates 8 U.S.C. § 1324, allowing prosecution of officials who shield them from federal authority. The Supremacy Clause mandates compliance; defiance undermines it, inviting federal charges.

Mora's victim, the 21-year-old from 2011, learned of his fleeting freedom. Her safety, protected by deportation once, now betrayed by a judge prioritizing ideology. Predators escalate: from assault to worse. Jack-Browne loosed a threat.

Policy Failures

Under Biden-era policies, Mora reentered unchecked after 2023's fake ID arrest. Catch-and-release failed, but federal warrants exist to rectify it. Judges cannot nullify them without consequence.

Accountability demands action. The Department of Justice must investigate under these statutes. Prosecute judges like Jack-Browne for obstruction and harboring. Judicial independence protects impartiality, not criminal acts. As in Joseph's case, indictments hold them accountable. Arrest all who obstruct federal warrants; it's not optional, it's law.

Federal agents upheld their duty. Jack-Browne broke it. Prosecute her and others; restore supremacy. In Manhattan's shadows, a woman's peace hung by a thread, sacrificed to sanctuary folly. No more.
